Convicting the innocent: A critique of theories of wrongful convictions
Date of this Version
In recent years, the incidence of wrongful convictions has become a matter of public concern in a number of countries. The response has been a growing body of research resulting in a broad consensus about the principal causes. The purpose of the present paper is to challenge this consensus and present an alternative approach to explaining why wrongful convictions occur. The paper is exploratory. It does not seek to present a full explanatory theory of wrongful convictions. Instead, its aims are to analyse the directions to be taken in the search for explanatory theories.
