Musculoskeletal injuries reduce the ability for military forces to train new personnel. Metabolic fitness has been used to predict injury risk in new Australian Army trainees. The purpose of the present study was to examine the validity of using metabolic fitness to determine injury risk in conditioned military trainees completing an arduous field training exercise.

Welcome to the Bond University Public Infrastructure Bulletin and Built Environment, edition 8. The Bulletin is published annually by the Institute of Sustainable Development & Architecture and is available in e-format on the Bond University website http://epublications.bond.edu.au/pib/. The website also has a link to the Bond University Working Paper Archive and contains copies of earlier editions of the Bulletin. Our present plan is to continue to offer the Bulletin annually and to progressively increase the number of contributions and refereed content. The Bulletin is one of the few journals that examines infrastructure in all its forms, including public policy, project finance, the economics of infrastructure investment and management, as well as subjects in the built environment including building design, construction and project management, complex project procurement and real property. The boundaries are never closed and we welcome contributions from all related subjects.

Extract:
In 2008, the American Bar Association published Final Report – Task Force on Improving Mediation Quality. Interestingly, the task force '[a]fter determining that a national credentialing program was not feasible for the current [US] mediation market place' (compare Australia!), retreated to the less controversial and arguably less difficult topic of 'factors that define high quality mediation practice.' (ABA p2).

Extract:
As with circuses, aquariums have been the subject of concern for animal welfare experts (Tilikum, Katina, Corky, Kasatka, and Ulises v. SeaWorld 2011): Is captivity the best place for these animals? Are these settings merely entertainment venues? If they provide an educational experience for viewers, does the learning experience outweigh the risks to the animals? Could the education be gained by other modes? What are the elements of animal welfare in the setting of an aquarium? After viewing the Edo—Kingyo’s Coolness Tokyo art exhibit online using the creator’s YouTube video (Kimura 2011), the importance of all of these questions becomes apparent.

The perils of prenuptial financial agreements in Australia: Effectiveness and professional negligence

Extract:
Legal practitioners in Australia who draft financial agreements before (s 90B; 90UB) or during a marriage or relationship (s 90C; 90UC) have a high risk of being guilty of professional negligence. Vigilance, protocols and expertise only reduce the risk; it is never eliminated. That is why a number of experienced and smart family lawyers in Australia will never draft pre-nuptial (s 90B; 90UB) or “during relationship” agreements. They send their clients to more naïve or risk-taking lawyers. In each case, the professional negligence and ineffective agreements lie dormant and hidden like hand grenades. The agreements will explode over say the 30 years which follow signing – either upon the separation of the signatory spouses, or the death of one, or a dramatic change of circumstances for better or worse of one of the spouses.

Extract:
The aim of this workshop is to provide a framework for a short teaching and learning course for people who are coaches in dispute resolution courses, especially mediation courses. The models used in this paper are based on theories and practices used at the former CDR Associates in Boulder Colorado, and at Bond University in Queensland, Australia, for the past 30 years. These, of course, walk in the footsteps of various ancient and modern educational theories and practices. Similar models can be used at any course involving “skills” teaching and learning.
