Abstract

This article provides an evaluation of the negotiate-arbitrate framework established by Pt IIIA of the Trade Practices Act, and considers the recommendations from the Productivity Commission in its final report looking into improving the framework. Ways of improving the consistency and efficiency of the negotiate-arbitrate process are examined. Pt IIIA of the Trade Practices Act governs third party access to the services of essential infrastructure facilities.
