Abstract
In this article, the author considers, against the backdrop of recent South Australian and Queensland Supreme Court decisions, the right of a corporation to withhold from its former directors privileged communications passing between the corporation and its legal advisers at a time when the directors still held office and which have since become material to the former directors' defence of legal proceedings instituted against them by either the corporation or a third party.
